Racby is operated by Racked Up Ltd., company number 202600662, with its address at Ground Floor, Rodney Court Building, Rodney Bay, Gros Islet, Saint Lucia.

In this Privacy Policy, “Racby”, “we”, “us”, and “our” refer to Racked Up Ltd. We act as the data controller for personal information processed through racby.com and the Racby services, subject to applicable law.

1.2Scope

This policy explains what personal information we may collect, why we use it, who we may share it with, how we protect it, how long we keep it, and how you can exercise applicable rights.

This policy applies to visitors, account holders, and people who contact Racby. It should be read together with the Terms and Conditions and any notice shown at the point where information is collected.

02Information we collect

2.1Information you provide

Depending on how you use Racby, we may collect your name, username, email address, phone number, date of birth or age confirmation, country of residence, account credentials, support messages, and information you provide when requesting account closure or self exclusion.

2.2Verification and compliance information

Where required for age, identity, payment ownership, source of funds, fraud prevention, anti money laundering, or other compliance checks, we may collect identity documents, proof of address, payment ownership information, source of funds information, and records of checks or decisions.

The exact documents and checks depend on the account activity, payment method, applicable law, and risk review.

2.3Transaction and account information

We may collect deposits, withdrawals, wagers, game results, balances, rewards, account status, payment references, cryptocurrency addresses, network details, and records of account security events.

We do not need your private wallet keys or recovery phrase. Never send them to Racby.

2.4Technical and usage information

When you use the website or services, we may collect device and browser information, IP address, approximate location derived from the IP address, language, operating system, pages or features used, timestamps, referral information, and security or diagnostic logs.

2.5Information from other sources

We may receive information from payment providers, identity and verification providers, fraud prevention services, game or platform providers, hosting and security providers, and public or lawful sources where permitted.

03How we use information

3.1Provide and administer Racby

We use information to create and secure accounts, provide games and account features, process transactions, calculate balances and rewards, respond to support requests, and maintain service records.

3.2Safety, fairness, and security

We use information to verify age and identity where required, prevent fraud and abuse, protect accounts, detect prohibited or connected accounts, investigate suspicious activity, maintain self exclusion safeguards, and keep the platform secure.

3.3Legal and compliance obligations

We use information to meet applicable legal obligations, including identity, payment, anti money laundering, sanctions, tax, record keeping, and lawful request obligations where they apply to Racby.

3.4Improve the service

We may use technical and usage information to troubleshoot errors, understand performance, improve usability, and maintain reliability.

3.5Communications

We use contact details to send service messages, security notices, transaction updates, support responses, and other communications needed to administer your account.

Marketing communications are handled under Section 9 and applicable law. Service messages are not marketing.

04Legal grounds for processing

4.1Applicable grounds

Depending on the purpose and applicable law, we may process information because it is necessary to provide a service or take steps at your request, comply with a legal obligation, protect vital interests, perform a public interest task where applicable, pursue a legitimate interest that is not overridden by your rights, or because you have given consent.

4.2Consent

Where processing relies on consent, you may withdraw consent using the method provided or by contacting support@racby.com. Withdrawal does not affect processing that already took place lawfully or processing that can continue on another lawful ground.

4.3Objection

Where applicable law gives you a right to object to processing based on legitimate interests or direct marketing, you may contact support@racby.com. We will handle the request within the period required by applicable law.

05Payments, identity checks, and fraud prevention

5.1Payment providers

Payment transactions may be processed by payment providers. We may receive payment status, transaction references, ownership checks, and limited payment details needed to reconcile the transaction and protect the account.

5.2Cryptocurrency

For cryptocurrency activity, we may process wallet addresses, transaction hashes, network information, amounts, confirmations, and related risk signals. Blockchain transactions may be public, and we may not be able to erase them.

5.3Verification and fraud controls

We may use third party services for identity, device, fraud, sanctions, or transaction risk checks. Those services may process information on our behalf or as independent controllers.

06When we share information

6.1Service providers

We may share information with providers that help us host, secure, operate, support, verify, process payments, deliver games, prevent fraud, and maintain the services. We use appropriate contractual or legal controls to protect information shared with these providers.

6.2Legal and safety disclosures

We may disclose information where required or permitted by applicable law, court order, lawful request, dispute process, fraud investigation, account security response, or protection of Racby, users, or another person.

6.3Business changes

If Racked Up Ltd. is involved in a sale, merger, financing, restructuring, or similar business change, information may be transferred as part of that process, subject to applicable law and continued protection under this policy.

6.4What we do not sell

We do not sell your personal information for money. We do not authorise publication of identity documents, contact details, payment information, or other private account information for publicity.

A winner name publicity permission, where applicable, is governed by Section 22 of the Terms and Conditions and does not override privacy rights or applicable consent requirements.

07International processing and transfers

7.1Provider locations

Some of the providers we use may process your information outside Saint Lucia.

7.2Safeguards

When we transfer your personal information across borders, we use the safeguards required by applicable law and provide information about those safeguards where required.

08Retention and deletion

8.1Retention principles

We keep information only for as long as reasonably necessary for the purpose collected, account administration, security, dispute handling, legal obligations, record keeping, and the establishment, exercise, or defence of legal claims.

8.2Account closure and inactivity

Account closure does not necessarily result in immediate deletion. The Terms and Conditions address dormant balances, self exclusion safeguards, and retention needed to prevent account restriction bypass.

We may keep self exclusion records for as long as necessary to enforce your exclusion and prevent it from being bypassed.

8.3Deletion requests

We will consider deletion requests under applicable law. We may retain information where necessary for legal obligations, security, fraud prevention, dispute handling, accounting, transaction records, self exclusion safeguards, or other permitted purposes.

09Marketing and communications

9.1Service communications

We may send communications needed to operate your account, process transactions, provide security notices, respond to support requests, or administer Racby.

9.2Direct marketing

We will send direct marketing only where permitted by applicable law and with any consent or other required basis. You may ask us to stop direct marketing by contacting support@racby.com or using the unsubscribe method in the message.

If you opt out of marketing, we will still send you essential service and security messages.

9.3Publicity

Use of a winner’s name for advertising or promotion is addressed separately in Section 22 of the Terms and Conditions. This policy does not grant permission to publish private account information.

10Cookies and similar technologies

10.1Essential technologies

We may use cookies or similar technologies to keep you signed in, protect your account, remember your preferences, and operate our services.

10.2Optional technologies

Where we use optional analytics, measurement, personalisation, or marketing technologies, we obtain your consent when required by applicable law.

10.3Browser controls

You can control cookies through your browser settings. Blocking essential technologies may prevent parts of Racby from working.

11Security

11.1Protective measures

We protect your personal information using reasonable technical and organisational measures designed to prevent unauthorised access, loss, misuse, alteration, or disclosure.

No online service can guarantee absolute security. Keep your login details and authentication methods private and contact support@racby.com promptly if you suspect unauthorised access.

11.2Incident response

If a security incident affects your personal information, we assess the incident, take steps to address it, and notify you and the relevant authorities when required by applicable law.

12Your privacy rights

12.1Available rights

Depending on applicable law, you may have rights to request access to personal information, correction of inaccurate information, deletion, restriction or objection to certain processing, withdrawal of consent, and information about how your data is used.

12.2Making a request

Send a request to support@racby.com. Describe the request clearly and provide enough information for us to locate the relevant account or data. We may request identity verification before fulfilling a request about your account.

12.3Limits and response

Rights are subject to applicable legal limits and exemptions. We will respond within the period required by applicable law or explain why more time or information is needed.

12.4Complaints

If you believe we have mishandled your personal information or a privacy request, you can contact us so we can investigate. You may also have the right to contact the competent data protection authority under applicable law.

13Children and restricted users

Racby is not intended for people below the applicable minimum age. We do not knowingly permit underage account use. If we learn that we collected information from an underage person, we will take appropriate steps under applicable law.

People in restricted jurisdictions must not use Racby. The restricted jurisdiction list and eligibility rules are in the Terms and Conditions.

14Policy changes

We may update this policy to reflect changes to Racby, our processing, applicable law, or provider arrangements. We will display the updated version and effective date. Where required, we will provide additional notice or obtain consent.
