Terms and Conditions
The terms that govern your account and your use of Racby.
01General Information
1.1About Racby
Racby is operated by Racked Up Ltd., company number 202600662, with its address at Ground Floor, Rodney Court Building, Rodney Bay, Gros Islet, Saint Lucia.
In these Terms and Conditions, “Racby”, “we”, “us”, and “our” refer to Racked Up Ltd. “You” and “your” refer to the person accessing or using our services.
1.2These terms
These Terms and Conditions govern your use of racby.com and the services available through it. Please read them before creating an account, depositing funds, or playing any games.
By creating an account or using our services, you agree to these terms. If you do not agree, you must not use our services.
1.3Eligibility
You must be at least 18 years old, or the minimum legal gambling age where you are located if that age is higher.
You must not access or use our services from a restricted jurisdiction or anywhere your participation is prohibited by applicable law. You must provide accurate, complete, and current information when registering and using your account.
1.4Other rules
Specific game rules, promotional terms, and account policies may also apply. Where applicable, those rules form part of these terms and should be read before participating in the relevant game or promotion.
1.5Available games
The games and services available on Racby may change over time. We may add or remove games and services.
02Privacy Policy
2.1Your personal information
Please read our Privacy Policy for information about the personal data we collect, how we use and share it, how long we retain it, and the rights and choices available to you.
2.2Privacy questions
If you have questions about how your personal information is handled, contact us at support@racby.com.
03Responsible Gaming
3.1Play for entertainment
Our games are intended for entertainment. Gambling involves the risk of losing money and should not be treated as a source of income or a way to resolve financial difficulties.
3.2Taking a break and seeking support
If gambling is affecting your wellbeing, finances, or relationships, stop playing and consider seeking professional support.
You can contact support@racby.com to request account closure or self exclusion, or to raise concerns about your gambling.
3.3Respecting account restrictions
If your account has been restricted or closed because of gambling related concerns, you must not create or use another account to bypass that restriction or closure.
04Identity Verification (KYC)
4.1Verification checks
We may verify your identity, age, address, and other account information when you register, deposit, request a withdrawal, or use our services. Checks may be carried out by us or through third party verification providers.
4.2Information and documents
We may request identification documents, proof of address, or other information needed to complete these checks. Information must be accurate, complete, and current. We may request updated documents when necessary.
4.3Incomplete verification
We may restrict account access or hold withdrawals while required verification checks remain incomplete. If you fail to provide requested information or provide false or misleading information, we may suspend or close your account.
05Personal Information
5.1Correcting your information
You may request corrections to your personal information or update your name following a legal name change. Changes must relate to the same account holder and cannot be used to transfer the account to another person.
5.2Supporting documents
We may request identification or other supporting documents to verify a correction or name change.
5.3Making a request
Contact support@racby.com to request a correction. We will provide instructions for any verification required. Do not send identity documents by email unless directed to an approved submission method.
06Account Registration
6.1Creating an account
You must create an account before playing games for real money. Use one of the registration methods available on Racby, provide the requested information, and complete any required verification.
6.2One account per person
You may hold only one personal Racby account. If you discover that you have more than one account, contact support@racby.com. Confirmed multiple account violations are handled under Section 13.6.
You must not sell, transfer, purchase, or allow another person to use your account.
6.3Account security and sharing
Keep your login details and authentication methods secure. Contact support@racby.com promptly if you suspect unauthorised access. We recommend enabling two factor authentication where available.
Sharing login details or authentication methods with another person is strictly prohibited. Using the same device to access Racby accounts belonging to different people is also strictly prohibited. This applies even where the account holders belong to the same household. Sharing logins or devices in this way constitutes a breach of these Terms and Conditions.
6.4Registration and access restrictions
We may refuse registration or restrict, suspend, or close an account where eligibility requirements are not met, these terms are breached, or there are reasonable grounds to suspect fraud or unauthorised access.
6.5Withdrawal security cooldown
To protect your account, withdrawals will be temporarily disabled for 24 hours after a password change or failed login attempts identified as suspicious. We may lift this restriction before the 24 hour period ends once we have successfully verified your account ownership.
6.6Inactive accounts
An account is considered inactive after 12 consecutive months without a successful login or customer initiated account activity. Failed login attempts and background system activity do not count.
Where verified contact details are available, we will provide at least 30 days’ notice before closing an inactive account.
Inactive accounts with no balance, outstanding bets, pending withdrawals, or unresolved disputes will be permanently closed.
If an inactive account holds a real money balance, it will be marked dormant and the balance preserved for withdrawal, subject to any required verification. We will not reset or confiscate that balance, or charge inactivity fees, solely because the account is inactive.
Self excluded accounts are exempt from automatic closure and deletion under this policy. We will retain the information necessary to maintain the exclusion and prevent it from being bypassed.
Account closure does not necessarily result in immediate deletion of all records. We will delete or anonymise personal information when it is no longer needed, subject to applicable retention requirements and the maintenance of self exclusion safeguards.
6.7Restricted jurisdictions
You acknowledge that using the Website or its products and services may be illegal in certain countries. It is your responsibility to determine whether accessing and using the Website complies with the laws of your country. By using the Website, you confirm that gambling is not illegal in your place of residence.
Residents of Australia, Belgium, France, Spain, Germany, the United States, and the United Kingdom are prohibited from opening or using accounts (“Restricted Jurisdictions”). By using Racby, you confirm that you are not a resident of or residing in a Restricted Jurisdiction.
07Deposits
7.1Funding your account
You must have sufficient funds in your account before placing a bet. Racby does not offer credit. Demo games, where available, do not award real money winnings.
7.2Available methods and fees
Available deposit methods, supported currencies, minimum amounts, and any applicable Racby fees are shown in the deposit interface. Your payment provider or blockchain network may charge additional fees.
7.3Your own funds
Deposits must be made using funds and payment methods that belong to you. Depositing on behalf of another person or using another person’s payment details is prohibited.
We may request information to verify a deposit’s ownership or source and restrict account activity while these checks are completed.
7.4Debit and credit cards
You must successfully complete identity verification (KYC) before making a deposit using a debit or credit card. The card must be issued in your own name and belong to you. Using another person’s card is prohibited, even with their permission.
Card deposits are subject to approval by the card issuer and payment provider. You must complete any authentication or card ownership checks required for the transaction. A declined or unsuccessful payment will not be credited to your Racby account.
7.5Cryptocurrency deposits
Before sending a deposit, check the currency, network, deposit address, minimum amount, and any required memo or tag shown in your account.
Deposits are credited after the required network confirmations and applicable checks. Processing times vary. Transfers using incorrect details or unsupported networks may not be recoverable. The recovery provisions in Section 10.9 apply.
KYC is not a standard prerequisite for cryptocurrency deposits. However, we may request identity verification, proof of payment ownership, or information about the source of funds where needed for security, fraud prevention, or applicable compliance checks, regardless of the deposit method. Account activity or withdrawals may be restricted while required checks remain incomplete, as described in Section 4.
7.6Minimum deposit
The minimum deposit is USD 5, or the equivalent in a supported currency. This minimum applies to debit card, credit card, and cryptocurrency deposits. Deposits below this minimum will not be processed or credited to your account. Check the minimum shown in the deposit interface before sending funds.
7.7Currency values
Cryptocurrency values and exchange rates can change. The displayed equivalent in another currency may therefore change even when the amount of cryptocurrency held remains the same.
7.8Account balances
Funds held in your Racby account do not earn interest. Your account is intended for using Racby’s services, not as a savings account or currency exchange service.
08Account Administration
8.1Available balance
Your available balance is the amount you can use to place bets. Funds committed to unsettled bets or otherwise subject to a valid hold are not available for further betting or withdrawal.
8.2Bet settlement
When you place a bet, the stake is deducted or reserved from your available balance. Once the outcome is confirmed, any winnings or returned stakes are credited according to the applicable game rules.
8.3Balance errors
If you believe your balance or a transaction is incorrect, contact support@racby.com. We will review the relevant records and correct any confirmed error.
You must not knowingly use or withdraw funds credited to your account by mistake. We may reverse an incorrect credit and will explain any resulting adjustment.
09Payouts
9.1Crediting winnings
Winnings are credited to your Racby account once the game result has been confirmed and settled according to the applicable game rules.
9.2Checking results
We may verify a result or payout with the relevant game provider where necessary to investigate a suspected error or irregularity. Any confirmed correction will be reflected in your account and explained to you.
9.3Incorrect credits
If winnings are credited by mistake, the balance error provisions in Section 8 apply. If you have already withdrawn those funds, we may request their return and will provide an explanation of the error and the amount involved.
9.4Payment of large winnings
Racby reserves the right, where necessary, to pay large winnings in monthly instalments rather than a single payment.
If we exercise this option, we will notify you of the reason, the amount of each instalment, and the payment schedule before the arrangement begins. Payment by instalments does not reduce the total amount of valid winnings owed to you.
10Withdrawals
10.1Requesting a withdrawal
You may request a withdrawal up to your available balance through your Racby account. Available methods, transaction limits, and applicable fees are shown in the withdrawal interface.
Ordinary withdrawal requests must be made through your Racby account on the website. Requests made by phone or email will not be accepted. Returns during self exclusion are handled separately under Section 10.6.
10.2Verification and security
We may request identity, payment ownership, or source of funds verification before processing a withdrawal. Required checks must be completed before funds are released.
Withdrawals are disabled for 24 hours after a password change or failed login attempts identified as suspicious. We may lift this restriction earlier after successfully verifying account ownership.
10.3Payment details
Withdrawals must be sent to a payment account or wallet belonging to you. Check the currency, network, address, and any required memo or tag before submitting your request. Transfers sent using incorrect details may not be recoverable.
10.4Processing times
Racby offers instant cryptocurrency withdrawals, subject to verification and network conditions. Blockchain confirmation times may vary.
Card withdrawals take 1 to 5 business days.
The security holds and arrangements for paying large winnings in instalments described in these terms still apply.
10.5Deposit wagering requirement
Each deposit is subject to a 1x wagering requirement before an ordinary withdrawal. This means you must place bets with a combined value at least equal to the deposit amount. For example, a USD 100 deposit requires USD 100 in total wagers. This can be completed across multiple bets and does not need to be a single bet. Returns of unwagered deposited funds during self exclusion are handled separately as described below.
10.6Unwagered funds during self exclusion
Self exclusion does not waive identity verification, payment ownership, source of funds, or other applicable compliance checks. Where an account contains unwagered deposited funds, any return will be reviewed separately and will not be processed as an ordinary withdrawal. You will not be required or permitted to continue gambling to complete wagering requirements while self excluded.
10.7Withdrawal reviews
We may temporarily hold a withdrawal while investigating reasonable concerns about fraud, unauthorised access, payment ownership, or a breach of these terms.
Suspicion alone does not result in forfeiture. Any decision to void winnings or deduct funds must be based on a confirmed breach or error and the applicable terms. We will explain the decision and any adjustment, unless disclosure is prohibited by law.
10.8Withdrawal of bonus winnings
Withdrawal eligibility, wagering requirements, any required deposit, and any maximum winnings limit will be stated in the promotion’s terms before participation. Any cancellation of winnings above a promotional limit will apply only as expressly stated in those terms.
10.9Recovery of incorrect cryptocurrency deposits
If you send a cryptocurrency deposit using an incorrect currency or network, recovery may not be possible. Racby will only attempt recovery for deposits worth USD 1,000 or more, where recovery is technically feasible. Recovery is not guaranteed.
If funds are successfully recovered, a recovery fee of 10% of the recovered amount will be deducted before the remaining funds are credited to your account. No upfront payment is required. If no funds are recovered, no recovery fee will be charged.
11Closing your account
11.1Requesting closure
You may request account closure or self exclusion by contacting support@racby.com. We may request information to confirm account ownership.
11.2Remaining funds
Account closure does not automatically forfeit your real money balance. Remaining funds will be handled according to the withdrawal, verification, and investigation provisions in these terms.
For self excluded accounts, unwagered deposited funds follow the separate compliance review process. Further gambling is neither required nor permitted.
11.3Bonus funds
Unused bonuses and associated winnings will be handled according to the relevant promotion’s terms. Closing your account does not create additional rights to withdraw bonus funds.
11.4Closure by Racby
We may close accounts for reasons described in these terms, including confirmed breaches, fraud, or failure to meet eligibility requirements. We will explain the closure and how any remaining balance will be handled, unless disclosure is prohibited by law.
11.5Records and restrictions
Account closure does not necessarily mean immediate deletion of all records. Applicable retention requirements and self exclusion safeguards continue to apply. You must not create or use another account to bypass an exclusion or restriction.
12Your Responsibilities
12.1Eligibility and information
You must meet our age and location requirements, provide accurate information, and keep your account details current.
12.2Personal use
Use your account only on your own behalf. The rules prohibiting multiple accounts, account transfers, shared logins, and shared devices continue to apply.
12.3Lawful funds
Only use funds and payment methods that lawfully belong to you. You must not use Racby for money laundering, fraud, terrorism financing, or other unlawful activity.
12.4Fair play
You must not cheat, collude with other players, manipulate results, knowingly exploit technical errors, or use unauthorised software to gain an unfair advantage. Features provided or expressly permitted by Racby remain allowed.
12.5Conduct
You must not threaten, harass, impersonate, or abuse other users or Racby staff.
12.6Taxes and gambling risks
You are responsible for any tax reporting and payments applicable to your activity and winnings. Gambling involves the risk of losing money and must not be treated as an investment or a guaranteed source of income.
12.7Software and content
Use Racby’s software and content only as permitted by these terms. You must not infringe our intellectual property rights or those of our providers.
13Rewards and VIP Programs
13.1Participation
Eligible Racby accounts may participate in our rewards and VIP programs. Qualifying activity, reward calculations, and available benefits are described on the relevant program pages.
13.2Reward conditions
Rewards may have eligibility requirements, claim periods, expiry dates, or wagering conditions. These conditions will be stated in the applicable program or promotion terms.
13.3Personal benefits
Your VIP status and rewards belong to your account and cannot be sold, transferred, or shared with another person.
13.4Program changes
We may change or discontinue rewards, benefits, qualification requirements, or calculation methods. Material changes will be communicated before taking effect and will not retrospectively remove rewards already validly earned, subject to their existing claim and expiry conditions.
13.5Misuse and errors
We may review or temporarily restrict rewards where there are reasonable grounds to suspect fraud, manipulation, or a breach of the applicable terms. Rewards may be corrected or removed where an error or breach is confirmed. We will explain any resulting adjustment unless disclosure is prohibited by law.
13.6Zero tolerance for multiple and connected accounts
Racby has zero tolerance for multiple accounts, shared logins or authentication methods, shared devices used to access different people’s Racby accounts, or connected accounts used to bypass restrictions or abuse rewards.
Connected accounts include accounts operated or controlled by the same person, accounts used on another person’s behalf, and accounts coordinated to evade account limits, exclusions, or promotion rules. A referral relationship alone does not establish prohibited account activity.
We may suspend implicated accounts while investigating. Confirmed violations will result in closure of the accounts involved and cancellation of rewards or bonus winnings obtained through the violation. Any other adjustment to funds remains subject to the review and explanation provisions in these terms.
14Refunds and Payment Errors
14.1Completed bets
Bets are not refundable simply because you lose or change your mind. Technical errors and incorrectly settled bets will be reviewed under the applicable game rules and account correction provisions.
14.2Reporting an issue
If you believe a technical or payment error has incorrectly reduced your balance, contact support@racby.com. Include the relevant transaction or bet reference and any supporting information available.
Refund requests concerning a technical or payment error must be submitted within seven calendar days of the affected transaction or incorrect balance adjustment. Requests submitted after this deadline may be rejected.
14.3Investigation and correction
We will review the relevant records and correct confirmed errors. A refund or adjustment will reflect the actual error, not hypothetical winnings or outcomes that might otherwise have occurred.
14.4Supporting information
We may request documents or information needed to investigate your claim or verify account and payment ownership. You must provide the requested documents and information within five calendar days of our request. If you do not meet this deadline, we may decline the refund request.
The deadlines in Sections 14.2 and 14.4 do not limit any rights or remedies that cannot be excluded under applicable law.
14.5Relationship to withdrawals
A refund request is not an alternative route for withdrawing deposits without meeting the 1x wagering requirement. Confirmed error corrections and the process for self excluded accounts in Section 10.6 remain applicable.
14.6Fraudulent requests
Knowingly submitting false information or a fraudulent refund claim is a breach of these terms and may result in account restrictions or closure following investigation. An unsuccessful claim is not, by itself, evidence of fraud.
15Limitation of Liability
15.1Service availability
We cannot guarantee that Racby or its games will always be available or free from interruptions or errors. This does not remove our obligations to settle valid bets, correct confirmed errors, or account for funds owed to you.
15.2External disruptions
We are not responsible for losses caused solely by failures outside our reasonable control, such as your device, internet connection, or an external blockchain network, provided our own breach or negligence did not contribute to the loss.
15.3Indirect losses
To the extent permitted by applicable law, we are not liable for indirect or consequential losses, including lost business opportunities or anticipated profits. This does not exclude valid winnings or amounts otherwise owed under these terms.
15.4Liability that remains
Nothing in these terms excludes liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
16Disclaimer
16.1Availability of services
Games, payment methods, and other services may vary by location and change over time. We do not guarantee that a particular service will remain available indefinitely.
Changes do not remove our obligations concerning accepted bets, valid winnings, or funds owed to you.
16.2Website information
We aim to keep website information accurate and current, but errors or omissions may occur. If you notice an inconsistency affecting your account, a game, or a promotion, contact support@racby.com.
Confirmed errors will be handled under the applicable correction and game rules.
16.3Relationship to other terms
This disclaimer does not override Section 15 or exclude any rights or obligations that cannot lawfully be excluded.
17Anti Money Laundering
17.1Prohibited activity
You must not use Racby to launder money, finance terrorism, evade applicable sanctions, or transfer funds derived from unlawful activity.
17.2Verification and monitoring
We may review account activity and request identity documents, proof of payment ownership, or information about the source of funds.
KYC is required before using debit or credit cards. Cryptocurrency deposits do not require KYC by default, but verification may be required for security or applicable compliance checks.
17.3Your cooperation
You must provide accurate and complete information reasonably requested for these checks. You must not conceal payment ownership, provide false documents, or split transactions to avoid verification.
17.4Restrictions and investigations
We may delay or stop a transaction, restrict account activity, or suspend an account where there are reasonable grounds to suspect unlawful activity. Any action affecting funds remains subject to the investigation provisions in these terms and applicable law.
Completing the 1x wagering requirement does not replace verification or other compliance checks. Self exclusion does not waive these checks.
17.5Information sharing
We may share relevant information with verification providers, payment providers, and competent authorities where permitted or required by law, in accordance with our Privacy Policy. We may be unable to disclose certain reports or investigation details.
17.6Reporting concerns
Report suspected unauthorised or unlawful activity involving your account to support@racby.com promptly.
18Suspicious Activity and Account Restrictions
18.1Protective action
We may temporarily restrict account access, betting, deposits, or withdrawals where there are reasonable grounds to suspect unauthorised access, fraud, unlawful activity, or a breach of these terms.
18.2Investigation and outcomes
We may request information needed to investigate. Confirmed violations will be handled under the applicable account, rewards, and withdrawal provisions, including our zero tolerance policy for multiple and connected accounts.
Suspicion alone does not establish a right to confiscate funds. Any adjustment must follow the investigation and explanation requirements in Sections 8 and 10.7.
18.3VPNs and location restrictions
You must not use a VPN, proxy, or other technology to bypass location restrictions, verification checks, self exclusion, or account restrictions. We may ask you to disable these tools where necessary to verify your location or investigate account activity.
18.4Restricted disclosures
We will explain restrictions and decisions where we can, but may withhold information where disclosure is prohibited by law.
19General Game Rules
19.1Placing bets
You must have an eligible account and sufficient available funds. A bet is accepted only when received and validated by Racby or the relevant game provider’s system.
19.2Applicable rules
Each accepted bet is governed by the terms and game rules in effect when it was accepted. Once confirmed, a bet cannot be changed or cancelled by you unless the game rules expressly allow it.
19.3Results and settlement
Valid winnings are credited once the result is confirmed. Account closure alone does not void an accepted bet or valid winnings. Investigations and confirmed violations are handled under the relevant provisions of these terms.
19.4Disconnections
Losing your connection does not automatically cancel an accepted bet or entitle you to a refund. Accepted bets will be settled under the applicable game rules. Any amount deducted for a bet that was not accepted will be restored.
19.5Technical malfunctions
If a confirmed malfunction prevents a valid result, the affected round will be voided and its stake returned. Any winnings generated by that invalid round will be reversed. Unaffected bets remain valid.
19.6Incorrect payouts
Confirmed calculation or paytable errors may be corrected under the applicable game rules and account correction provisions. We will explain any adjustment. This does not permit ordinary payout changes to be applied retrospectively to accepted bets.
19.7Prohibited play
Cheating, collusion, exploitation of errors, and prohibited multiple or connected accounts are subject to the investigation and enforcement rules in Sections 10.7, 13.6, and 18.
20General Terms
20.1Governing law and courts
These Terms and Conditions and disputes arising out of or in connection with them are governed by the laws of Saint Lucia.
Subject to any mandatory legal requirements, the courts of Saint Lucia have exclusive jurisdiction over such disputes.
Nothing in this clause deprives you of mandatory protections under applicable law or any right to bring a claim in another court where that right cannot lawfully be excluded.
20.2Severability
If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent they can operate independently.
20.3Entire agreement
These terms, together with the applicable game rules, promotion terms, and policies expressly incorporated into them, form the agreement governing your use of Racby. Nothing in this clause excludes liability for fraud or rights that cannot lawfully be excluded.
20.4Transfer of the business
We may transfer our rights and obligations under these terms as part of a business sale, merger, or restructuring. We will notify you of any change to the operator. The transfer must preserve your existing rights and account balances, and personal information must be handled in accordance with applicable law and our Privacy Policy.
You may not sell, transfer, or assign your account to another person.
20.5External websites
Links to external websites do not constitute an endorsement. Those websites operate under their own terms and privacy policies. Our liability remains subject to Section 15.
20.6Changes to these terms
We may update these terms and will display the effective date. Material changes will be communicated before taking effect, except where an immediate change is necessary for legal or security reasons.
Changes will not retrospectively alter accepted bets or remove amounts already validly owed. If you disagree with a change, you may stop using Racby and request account closure under Section 11.
20.7Language
Where translations are provided, the English version governs any inconsistency, except where applicable law requires otherwise.
20.8Losses caused by misuse
To the extent permitted by law, you may be responsible for reasonable, documented losses directly caused by your fraud, unlawful activity, or deliberate breach of these terms. This does not make you responsible for losses caused by Racby’s own breach or negligence.
21Complaints
21.1Making a complaint
Contact support@racby.com with your account details, a description of the issue, and any relevant transaction or bet references. Do not send passwords or authentication codes.
21.2Reviewing your complaint
We will review the relevant records and supporting information. If support cannot resolve the matter, it will be escalated internally. We will keep you reasonably informed and explain the outcome.
21.3Account holder only
Complaints must be submitted and handled directly by the account holder. Racby does not accept complaints submitted or managed by third party representatives, except where applicable law requires otherwise. We may verify account ownership before discussing a complaint or sharing account information.
21.4Records
Racby’s server logs, transaction records, and game records constitute the authoritative and conclusive record for account activity and settlement, except where a manifest error is established or applicable law requires otherwise.
21.5Further action
If you remain dissatisfied, you may pursue any remedies available under applicable law, subject to the governing law and court provisions in Section 20.
The seven calendar day deadline in Section 14 applies to technical or payment refund claims. It is not a blanket deadline for every type of complaint.
22Publicity
22.1Permission to use a winner’s name
By accepting a contest prize or winnings from Racby, you grant Racby permission to use your name for advertising and promotional purposes without additional compensation, except where prohibited by applicable law.
22.2Scope and applicable rights
This permission concerns the use of your name for publicity. It does not authorise publication of identity documents, contact details, payment information, or other private account information.
This clause does not override any consent requirements or rights that cannot lawfully be excluded. Personal information is otherwise handled in accordance with our Privacy Policy.
